Brazil's Supreme Court sets 3 November hearing on the betting ban

In short

Supreme Federal Court rapporteur Luiz Fux has scheduled a public hearing for 3 November at 10:00 to discuss challenges to Brazil's betting ban. It is the first court step since the election.

Why it matters in South Africa

Brazil is a live example of a regulated online gambling market being shut down by decree, then argued over in court. South Africa has no licensed online casino sector, so nothing changes for players here. The case does show how quickly the rules can move, and why we separate "accepts South African players" from "licensed in South Africa" on every casino page.

What happened

iGaming Business reported on 27 October 2026 that Luiz Fux, a justice of Brazil's Supreme Federal Court (STF), has called a public hearing for 3 November at 10:00 in the court's 2nd Chamber. The Attorney General's Office, the authors of a constitutional challenge known as ADI 8.027 and several friends of the court asked for it.

The hearing concerns Provisional Measure 1,394, issued by President Lula about a month before. The measure banned the operation, offering, intermediation and advertising of betting in Brazil.

Why now

The report says Fux held off during the election so that nothing he did could be read as political interference. He now describes the hearing as urgent because of the deadlines written into the provisional measure and the economic effect on Brazilian football and other sectors, with legal certainty in mind.

The hearing is not limited to the new measure. It also feeds into six earlier cases, ADIs 7.721, 7.723, 7.749, 8.024, 8.028 and 8.035, which were already testing betting regulation.

Who has been invited

The ruling lists 26 participants. They include the Attorney General of the Union, the Ministry of Finance, business and industry associations, the Brazilian Association of Criminal Lawyers, a university regulation laboratory, broadcasters and the Brazilian Football Confederation.

Many top-flight football clubs are on the list too, among them Flamengo, Fluminense, Corinthians and São Paulo. Industry bodies ANJL and IBJR have asked the court to suspend the measure as unconstitutional, while the government has asked for the ban to stay in full.

What it means for South African players

For a South African reader the lesson is about stability. A licence from a foreign regulator is only as secure as the law behind it, and a sudden change can leave players waiting for balances or support.

What to watch next

Watch the 3 November hearing itself and any decision from Fux afterwards. Congress also has a say on the measure, as covered in our earlier report. A hearing is a fact-gathering step, not a ruling, so nothing is decided on the day.
