Brazilian appeals court cancels Stake's right to keep operating until 25 October

In short

The president of Brazil's TRF-3 appeals court suspended the injunction that allowed Stake to operate until 25 October 2026, so the operator is blocked again. The court did not rule on whether the national betting ban is lawful.

Why it matters in South Africa

Brazil is far from South Africa, but this shows how fast an operator's position in one market can reverse. South Africa has no licensed online casino regime, so South African players rely on offshore licences, and a licence or court win elsewhere says little about how an operator will treat players here. Read the licence details and terms on any site before you deposit, and see our casino reviews for what we have and have not verified.

What the court decided

A federal appeals court in Brazil has switched Stake's access to the Brazilian market off again, only days after a lower court switched it on. Reporting by iGaming Business on 13 October 2026 says the president of the Federal Regional Court of the 3rd Region (TRF-3) suspended an injunction that had let the operator keep running until 25 October.

The earlier injunction came from a São Paulo federal judge on 8 October. The appeals judge acted on a request from the Attorney General's Office, which argued that the order gave Stake an unfair edge over other betting companies.

The reasoning behind the reversal

According to the report, the appeals judge accepted that letting one operator carry on while the rest of the market was bound by the same rules created inequality and could prompt other companies to seek similar orders. The ruling cited protection of bettors and a lack of transparency in how online gambling works.

The decision does not rule on the underlying case, and it does not say whether the government's provisional measure is constitutional. That question is still before Brazil's Supreme Federal Court, where two gambling trade bodies have challenged the measure. The suspension stays in force until the case ends or the court's presidency decides otherwise.

What it means for South African players

Nothing changes directly for players here, because Stake's Brazilian licence has no bearing on whether it accepts South African customers. The story is a reminder that a court win can be reversed within days, and that an operator's position in one country says little about its position in another.

  • Check where an operator is licensed and whether it accepts South African players before you register.
  • Keep your balance low and withdraw winnings you do not intend to play with.
  • Do not treat an operator's presence in a market as proof that the market is stable.

What to watch next

The Supreme Federal Court's handling of the trade bodies' challenge is the main thing to follow, along with whether federal agencies now carry out the blocking measures the provisional measure allows. Stake did not respond to iGaming Business's request for comment, and the operator's own statements will be worth reading when they appear.
