US Election Day puts online sports betting, racing venues and a new casino licence to voters
On 3 November 2026 voters in three US states faced gambling questions: Nebraska on online sports betting tied to racetracks, two Virginia localities on pari-mutuel satellite venues, and three Indiana counties on a single new casino licence. Results were not available when we checked, so this brief covers what was on the ballot.
These are US state votes and do not affect South African law or the offshore casinos that accept South African players. They are useful as a signal of how legal gambling is expanding through public votes elsewhere, while South Africa still has no licensed remote casinos and its reform bill remains unresolved. Read it as background, not as a change to your options here.
What is on the ballot
According to iGaming Business, gambling is not a single national question this Election Day, but three states have measures that matter to parts of the industry: Nebraska, Virginia and Indiana.
Nebraska: online sports betting tied to racetracks
Nebraska voters face two linked questions, Initiatives 440 and 441, and both must pass. Measure 440 is a constitutional amendment allowing the legislature to authorise online sports wagering for operators connected to a licensed racetrack that offers wagering. Measure 441 would let the state Gaming Commission write the rules, with a deadline of 1 June 2027.
The reported terms include a cap of two skins per operator, servers located in Nebraska and responsible gambling controls. BetMGM, DraftKings, FanDuel and Fanatics are reported to back Measure 441, while opponents have raised addiction concerns.
Virginia and Indiana
- Virginia: the town of Pulaski and Amherst County vote on allowing pari-mutuel wagering at satellite facilities. A yes vote only removes a local barrier, and a state licence would still be needed. Amherst voters rejected a similar proposal in 2021.
- Indiana: Allen, DeKalb and Steuben counties vote on whether to allow a possible inland casino. A 2026 law created one new licence, with a reported US$150 million licence fee and a decision due by 15 April 2027.
What it means for South African players
Nothing changes for you directly. The votes are about licensed, state-regulated gambling in the US. In South Africa the position is different: no operator holds a licence for remote casino games, and the market is served by offshore sites. Our South Africa guide explains the difference between not licensed here and accepts South African players. Gambling carries a real risk of loss and should only ever be entertainment.
What to watch next
Watch for certified results from each state. In Nebraska, passage would start rule-making towards the June 2027 deadline. In Indiana, any approving county would still need a developer to apply to the Indiana Gaming Commission.
